OnlyPlants Privacy Policy

This Privacy Policy explains how Snowbird Agility, Inc. ("Snowbird," "we," "us," or "our") collects, uses, shares, and protects information about you when you use the OnlyPlants mobile application and related services (the "App"). By downloading, installing, or using the App, you agree to the collection and use of information as described in this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms and Conditions.

1. Information We Collect

We collect information in three ways: information you provide directly, information collected automatically when you use the App, and information from third parties.

A. Information You Provide

When you create an account or use the App, you may provide:

• Account information, including your name, email address, and password
• Garden data, including bed dimensions, plant selections, planting dates, and notes
• Seed inventory and harvest records you enter manually
• Photos and other content you upload to the App ("User Content")
• Communications you send to us, including support requests and feedback
• Location data you enter manually, such as your city or zip code, for planting calendar features

B. Information Collected Automatically

When you use the App, we and our service providers may collect:

• Device identifiers, such as your device type, operating system, and unique device ID
• Log data, including IP address, access times, pages viewed, and crash reports
• Usage data, including features used, session duration, and interactions within the App
• Precise or approximate location data, if you grant location permission, for weather alerts and regional planting recommendations
• Camera data, if you grant camera permission, for features that allow you to photograph plants or garden spaces. We do not retain camera data beyond the immediate use unless you choose to save it

C. Information from Third Parties

We may receive information from third-party services integrated with the App, including:

• Weather data providers, such as temperature, frost probability, and precipitation forecasts tied to your location
• App store platforms (Apple App Store and Google Play) for account authentication and subscription management
• Analytics providers that help us understand how the App is used

2. How We Use Your Information

We use the information we collect to:

• Operate the App and provide its core features, including garden planning, planting calendars, seed inventory, and weather alerts
• Create and manage your account
• Personalize your experience, including region-specific planting recommendations and frost or heat alerts based on your location
• Process any future purchases or subscriptions through the applicable app store
• Send you service-related communications, including updates, security alerts, and support responses
• Send you promotional communications about new features or offers, if you have opted in (you may opt out at any time through the App or by contacting us)
• Analyze usage patterns to improve the App and develop new features
• Detect, investigate, and prevent fraud, abuse, and security incidents
• Comply with legal obligations

We do not sell your personal information to third parties for their own marketing purposes.

3. How We Share Your Information

We may share your information in the following circumstances:

A. Service Providers

We share information with third-party vendors who help us operate the App, including cloud hosting providers, analytics services, weather data providers, and customer support platforms. These providers are contractually required to use your information only to perform services for us and to protect it appropriately.

B. App Store Platforms

If you download the App from the Apple App Store or Google Play, those platforms may collect certain information in connection with your use. Their collection and use of that information is governed by their own privacy policies, not ours.

C. Business Transfers

If Snowbird Agility, Inc. is involved in a merger, acquisition, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will notify you via the App or by other reasonable means before your information becomes subject to a materially different privacy policy.

D. Legal Compliance and Protection

We may disclose your information if required to do so by law, regulation, or legal process, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Snowbird Agility, Inc., our users, or the public.

E. With Your Consent

We may share your information for other purposes with your express consent.

We do not share your garden data, photos, or location with other users unless you explicitly choose to make that content public through a community feature, if and when such a feature becomes available.

4. Location Data

The App uses location data to provide weather alerts (including frost and heat warnings) and region-specific planting recommendations. We request location permission through your device's standard permission system. You may grant or deny this permission at any time through your device settings.

If you deny location permission, you can still use the App by entering your city, state, or zip code manually. Manual location data is used the same way as device location data.

We do not sell location data. We share it with weather data providers only to the extent necessary to return forecasts and alerts to you.

5. Camera Data

If you grant camera permission, the App may access your device camera to allow you to photograph plants or garden spaces. Photos you take within the App are:

• Stored locally on your device unless you choose to save them to your account
• Uploaded to our servers only if you explicitly save or share them within the App
• Not used for facial recognition or biometric identification
• Not shared with third parties except as necessary to provide the feature (for example, temporary storage in our cloud infrastructure)

You may revoke camera permission at any time through your device settings. Revoking permission does not delete photos you have already saved to your account.

6. User Content

Photos, notes, and other content you upload to the App ("User Content") remain yours. We do not claim ownership of User Content. We store it on your behalf and use it only to provide and improve the App, as described in this Privacy Policy and in our Terms and Conditions.

You may delete your User Content at any time through the App. After deletion, we will remove it from our active systems. Residual copies may remain in backup systems for a limited period before being purged in the ordinary course of our backup rotation.

7. Data Retention

We retain your information for as long as your account is active or as needed to provide the App. You may delete your account at any time through the App's settings. Upon account deletion:

• Your profile and garden data will be removed from our active systems within 30 days
• User Content will be removed from active systems within 30 days, with residual copies purged from backups in the ordinary course
• Aggregated or anonymized data derived from your use may be retained indefinitely and cannot be linked back to you
• We may retain information as required by law or for legitimate business purposes, such as resolving disputes or enforcing our agreements

8. Security

We use commercially reasonable technical and organizational measures to protect your information from unauthorized access, disclosure, alteration, and destruction. These measures include encrypted data transmission, access controls, and regular security reviews.

No method of transmission over the internet or electronic storage is completely secure. We cannot guarantee the absolute security of your information. If you believe your account has been compromised, please contact us immediately at the address below.

9. Children's Privacy

The App is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly.

If you believe that a child under 13 has provided us with personal information, please contact us at the address below so we can investigate and take appropriate action.

10. Your Choices and Rights

Depending on where you live, you may have certain rights regarding your personal information. Regardless of location, you can:

• Access and update your account information through the App's settings
• Delete your account and associated data through the App's settings
• Opt out of promotional communications by following the unsubscribe instructions in any email we send, or by contacting us directly
• Adjust location and camera permissions through your device settings at any time

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we have collected about you, the right to request deletion, and the right to opt out of the sale of your personal information (we do not sell personal information). We will respond to verifiable requests within the timeframes required by applicable law.

11. Third-Party Links and Services

The App may contain links to third-party websites or integrate with third-party services (such as weather data providers and app store platforms). This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use in connection with the App.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of the App after the effective date of the updated Privacy Policy constitutes your acceptance of the changes.

We encourage you to review this Privacy Policy periodically. The "last updated" date at the bottom of this document reflects the most recent revision.
