OnlyPlants Terms and Conditions

Welcome to OnlyPlants. These Terms and Conditions ("Terms") govern your use of the OnlyPlants mobile application and related services (the "App") provided by Snowbird Agility, Inc. ("Snowbird," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you also agree to the Privacy Policy.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or legal guardian's permission to use the App and that they have read and agreed to these Terms on your behalf.

2. Your Account

You may use the App as a guest or by creating an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at the contact information below if you suspect unauthorized use.

Guest sessions are stored locally on your device. If you uninstall the App or lose your device, guest data may be permanently lost. We recommend creating an account if you want your data preserved. We are not responsible for any loss of data, including User Content, whether due to device issues, software errors, or other causes.

3. License to Use the App

Subject to your compliance with these Terms, Snowbird Agility, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on a device you own or control.

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App; (c) remove any proprietary notices; (d) use the App for any unlawful purpose; or (e) use the App to develop a competing product.

4. Free and Premium Features

The App currently offers free features. We may, in the future, introduce paid premium features or subscriptions. If we do, additional terms specific to those features (including pricing, billing, and cancellation terms) will be presented to you before purchase, and your continued use of premium features will constitute acceptance of those additional terms.

All purchases made through the Apple App Store or Google Play Store are subject to those platforms' terms of sale, including refund and cancellation policies. If subscriptions are introduced, they will automatically renew unless canceled through your Apple App Store or Google Play account. Billing, refunds, and cancellations are handled by the applicable app store provider, and we do not provide refunds directly.

5. Gardening Guidance Disclaimer

THE APP PROVIDES GENERAL GARDENING INFORMATION AND IS NOT A SUBSTITUTE FOR PROFESSIONAL HORTICULTURAL, AGRICULTURAL, MEDICAL, OR OTHER PROFESSIONAL ADVICE.

Gardening involves variables we cannot control or predict, including but not limited to local weather, soil composition, pests, plant variety, water quality, and your own gardening practices. Recommendations provided by the App, including planting calendars, harvest windows, weather alerts, and any AI-generated guidance, are estimates only.

Do not rely on the App to determine whether a plant is safe to eat, handle, or be near. Some plants are toxic to humans or animals. If you are unsure whether a plant is safe, consult a qualified horticulturist, your local poison control center, or a medical professional. We are not responsible for crop loss, illness, injury, allergic reaction, property damage, or any other harm resulting from your use of the App. Your use of the App is at your own risk.

6. Weather Data

The App displays weather forecasts and alerts (including frost and heat warnings) using data from third-party providers. Weather data is inherently uncertain and may be delayed, inaccurate, or unavailable. Do not rely on the App as your sole source of weather information for decisions that could affect your safety, your crops, or your property.

7. Location and Camera Permissions

The App may request access to your device's location and camera to provide core features. You may grant or deny these permissions through your device settings. Some features will not work without them. Information collected through these permissions is handled in accordance with our Privacy Policy.

8. User Content

You may upload photos, notes, and other content to the App ("User Content"). You retain ownership of your User Content. By uploading it, you grant Snowbird Agility, Inc. a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display your User Content for the purpose of operating and improving the App.

You are solely responsible for your User Content. You represent that you have all rights necessary to upload it and that it does not violate any law or third-party right.

9. Prohibited Conduct

You agree not to:

• Use the App in violation of any applicable law or regulation
• Upload content that is illegal, infringing, harmful, or harassing
• Attempt to gain unauthorized access to the App or other users' accounts
• Interfere with or disrupt the App's operation or servers
• Use automated tools (bots, scrapers) to access the App without our written permission
• Misrepresent your identity or affiliation

10. Intellectual Property

The App, including all software, text, images, logos, and other content (excluding User Content), is owned by Snowbird Agility, Inc. or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

11. Third-Party Services

The App may integrate with or link to third-party services, including weather data providers, app store platforms, and authentication services. We are not responsible for the content, policies, or practices of those third parties. Your use of those services is governed by their respective terms.

12. Termination

You may stop using the App at any time and delete your account through the App's settings. We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and dispute resolution) will survive.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNOWBIRD AGILITY, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CROPS, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

15. Indemnification

You agree to indemnify and hold harmless Snowbird Agility, Inc., its affiliates, and their respective officers, directors, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) your use of the App, (b) your violation of these Terms, or (c) your violation of any third-party right.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration. Arbitration will take place in Dorchester County, Maryland. Subject to the foregoing arbitration provision, any legal action that is not subject to arbitration will be brought in the state or federal courts located in Dorchester County, Maryland, and you consent to the personal jurisdiction of those courts.

17. Apple App Store and Google Play Provisions

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Snowbird Agility, Inc., not Apple, and Apple is not responsible for the App or its content. You acknowledge that Apple has no obligation to furnish any maintenance or support services with respect to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. If you downloaded the App from Google Play, similar provisions apply with respect to Google.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of the App after the effective date of the updated Terms constitutes acceptance of those Terms.
